(\u00a0\u00bb enautics \u00ab\u00a0, \u00a0\u00bb nous \u00a0\u00bb ou \u00a0\u00bb nous \u00ab\u00a0) et les utilisateurs du SaaS de enautics (\u00a0\u00bb vous \u00a0\u00bb ou \u00a0\u00bb client \u00ab\u00a0).<br \/>\nCe SLA s&rsquo;applique s\u00e9par\u00e9ment \u00e0 chaque compte utilisant le SaaS de enautics.<br \/>\nSauf indication contraire dans le pr\u00e9sent document, ce SLA est soumis aux conditions des CGU, et les termes en majuscules auront la signification sp\u00e9cifi\u00e9e dans les CGU.<br \/>\nenautics se r\u00e9serve le droit de modifier les termes de ce SLA conform\u00e9ment aux CGU.   <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-802b03d elementor-widget elementor-widget-text-editor\" data-id=\"802b03d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>1. Engagement de service<\/h3>\n<p>Enautics fera des efforts commercialement raisonnables pour rendre le SaaS d&rsquo;Enautics disponible 99,95 % du temps.<br \/>\nSi enautics n&rsquo;atteint pas l&rsquo;objectif de 99,95 % de disponibilit\u00e9 de l&rsquo;API au cours d&rsquo;un mois calendaire donn\u00e9 (\u00a0\u00bb Pourcentage mensuel de disponibilit\u00e9 \u00ab\u00a0), vous serez \u00e9ligible pour recevoir un cr\u00e9dit de service tel que d\u00e9crit ci-dessous. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-026aa83 elementor-widget elementor-widget-text-editor\" data-id=\"026aa83\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>2. D\u00e9finitions<\/h3>\n<p>Les termes suivants, commen\u00e7ant par une majuscule, ont la signification indiqu\u00e9e ci-dessous :<\/p>\n<p>2.1 \u00a0\u00bb Temps d&rsquo;indisponibilit\u00e9 \u00a0\u00bb signifie que le SaaS de enautics n&rsquo;est pas disponible pour \u00eatre utilis\u00e9 selon les services de performance et de surveillance contract\u00e9s par enautics \u00e0 sa seule discr\u00e9tion (le \u00a0\u00bb Service de surveillance \u00ab\u00a0).<br \/>\nLes rapports de disponibilit\u00e9 du service de surveillance sont actuellement disponibles \u00e0 l&rsquo;adresse status.enautics.com ; \u00e9tant entendu que les probl\u00e8mes ou pannes de service li\u00e9s \u00e0 des exclusions (d\u00e9finies ci-dessous) ne seront pas consid\u00e9r\u00e9s comme des p\u00e9riodes d&rsquo;indisponibilit\u00e9. <\/p>\n<p>2.2 Le \u00ab\u00a0pourcentage mensuel de disponibilit\u00e9\u00a0\u00bb est calcul\u00e9 en soustrayant de 100 % le pourcentage de p\u00e9riodes continues de 5 minutes au cours du mois de service pendant lesquelles le SaaS enautics \u00e9tait en \u00e9tat de \u00ab\u00a0temps d&rsquo;indisponibilit\u00e9\u00a0\u00bb, tel qu&rsquo;identifi\u00e9 par le service de surveillance.<\/p>\n<p>2.3 Un \u00ab\u00a0cr\u00e9dit de service\u00a0\u00bb est un cr\u00e9dit en dollars, calcul\u00e9 comme indiqu\u00e9 ci-dessous, qu&rsquo;enautics peut cr\u00e9diter sur le compte d&rsquo;un client \u00e9ligible :<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7f12c46 elementor-widget elementor-widget-text-editor\" data-id=\"7f12c46\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n<li>Pour un mois civil o\u00f9 le pourcentage mensuel de disponibilit\u00e9, tel qu&rsquo;identifi\u00e9 par le service de surveillance, enautics, \u00e0 sa seule discr\u00e9tion, apr\u00e8s avoir confirm\u00e9 la nature et l&rsquo;exactitude du temps d&rsquo;indisponibilit\u00e9, cr\u00e9ditera le compte du client d&rsquo;un pourcentage de la facturation de ce mois, tel que d\u00e9fini par ce tableau :<\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0084a6b class=\"uael-table__text\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"uael-table__text-inner\">10%  <\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/td>\n\t\t\t\t\t\t\t\t\t<\/tbody>\n\t<\/table>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-534ae8a elementor-widget elementor-widget-text-editor\" data-id=\"534ae8a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n<li>Un cr\u00e9dit de service sera attribu\u00e9 au solde enautics du client pour une utilisation future uniquement.<br \/>\nAucun remboursement ou valeur en esp\u00e8ces ne sera accord\u00e9.<br \/>\nLes cr\u00e9dits de service ne peuvent \u00eatre transf\u00e9r\u00e9s ou appliqu\u00e9s \u00e0 un autre compte.  <\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-326c235 elementor-widget elementor-widget-text-editor\" data-id=\"326c235\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>3. Proc\u00e9dures de demande de cr\u00e9dit et de paiement<\/h3>\n<p>Pour demander un cr\u00e9dit de service, le client doit soumettre un ticket via le portail de compte dans les 30 jours suivant le mois au cours duquel la p\u00e9riode d&rsquo;indisponibilit\u00e9 s&rsquo;est produite.<br \/>\nLe ticket doit contenir les \u00e9l\u00e9ments suivants<br \/>\n(i) \u00ab\u00a0R\u00e9clamation SLA\u00a0\u00bb comme objet du ticket ;<br \/>\n(ii) les dates et heures de la p\u00e9riode d&rsquo;indisponibilit\u00e9 pour laquelle vous demandez un cr\u00e9dit ; et<br \/>\n(iii) toute information applicable qui documente la panne r\u00e9clam\u00e9e.    <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7744f71 elementor-widget elementor-widget-text-editor\" data-id=\"7744f71\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>4. Les exclusions<\/h3>\n<p>Nonobstant toute disposition contraire, aucune p\u00e9riode d&rsquo;indisponibilit\u00e9 ne sera consid\u00e9r\u00e9e comme ayant eu lieu en ce qui concerne toute indisponibilit\u00e9, suspension ou r\u00e9siliation du SaaS d&rsquo;enautics, ou tout autre probl\u00e8me de performance du SaaS d&rsquo;enautics, qui<br \/>\n(i) sont caus\u00e9s par des facteurs \u00e9chappant au contr\u00f4le raisonnable d&rsquo;enautics, y compris, sans s&rsquo;y limiter, tout \u00e9v\u00e9nement de force majeure, les probl\u00e8mes ou questions li\u00e9s au transporteur, ou l&rsquo;acc\u00e8s \u00e0 Internet ou les probl\u00e8mes connexes au-del\u00e0 du point de d\u00e9marcation d&rsquo;enautics ou de ses sous-traitants d&rsquo;h\u00e9bergement direct (c&rsquo;est-\u00e0-dire au-del\u00e0 du point du r\u00e9seau o\u00f9 enautics maintient l&rsquo;acc\u00e8s et le contr\u00f4le sur les services d&rsquo;enautics) ;<br \/>\n(ii) r\u00e9sulter d&rsquo;actions ou d&rsquo;inactions du client ou d&rsquo;un tiers (autre que le sous-traitant direct d&rsquo;enautics en mati\u00e8re d&rsquo;h\u00e9bergement) ;<br \/>\n(iii) r\u00e9sultent d&rsquo;applications, d&rsquo;\u00e9quipements, de logiciels ou d&rsquo;autres technologies et\/ou d&rsquo;\u00e9quipements, de logiciels ou d&rsquo;autres technologies de tiers (autres que les \u00e9quipements de tiers sous le contr\u00f4le direct d&rsquo;enautics) ; ou<br \/>\n(iv) d\u00e9coulent de la suspension et de la r\u00e9siliation par enautics du droit du client d&rsquo;utiliser les services d&rsquo;enautics conform\u00e9ment aux CGU,<br \/>\n(v) la maintenance programm\u00e9e ; ou<br \/>\n(vi) des probl\u00e8mes ou des questions li\u00e9s \u00e0 des fonctionnalit\u00e9s ou des produits alpha, b\u00eata ou non g\u00e9n\u00e9ralement disponibles d&rsquo;Enautics (collectivement, les \u00ab\u00a0Exclusions\u00a0\u00bb).      <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7d2a990 elementor-widget elementor-widget-text-editor\" data-id=\"7d2a990\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>5.
